How to Buy Land in Nigeria Without Getting Scammed (C of O, Survey, Governor’s Consent)

Land is one of the biggest things most Nigerians ever buy — and one of the easiest places to lose money. Fake owners, land sold to several people, government-acquired plots and “omonile” wahala are common. These are the checks to do before you pay, and the papers you must collect after.

📄 The documents you will hear about

📜
Certificate of Occupancy (C of O)

Issued by the state government. Shows the government recognises the holder’s right to the land (all land is held under the Land Use Act 1978).

Strongest title
✍️
Governor’s Consent

Needed when land that already has a C of O is sold on. Without it, the new buyer’s title is not complete.

🗺️
Survey plan

Drawn by a registered surveyor. Shows the exact size and boundaries, with coordinates you can check at the Surveyor-General’s office.

Must have
🤝
Deed of Assignment

The contract that transfers the land from seller to buyer. Should be stamped and registered at the state Land Registry.

🏛️
Excision / Gazette

For family or community land in some states (e.g. Lagos): shows the government released that land back to the community, so it can be sold.

Not enough

🔍 Checks to do before you pay

  1. Visit the land — more than onceGo on a weekday and at the weekend. Talk to neighbours: who owns it, has it been sold before, is there any dispute?
  2. Get a surveyor to do a “charting”Your own registered surveyor takes the coordinates to the Surveyor-General’s office to confirm the land is not under government acquisition, a road, a drainage channel or a right-of-way.
  3. Do a search at the Land RegistryWith the seller’s title number, a lawyer can check at the state Land Registry who the registered owner is and whether the land is mortgaged or has other claims.
  4. Hire your own property lawyerNot the seller’s lawyer. Your lawyer checks the papers, drafts or reviews the Deed of Assignment and handles registration.
  5. Pay to a traceable accountPay by bank transfer to the owner (or the family’s official account), never in cash to a middleman. Get receipts signed by the right people.
  6. Sign, then registerSign the Deed of Assignment with witnesses, then apply for Governor’s Consent / registration. Keep certified copies of everything.
⚠️
Red flags

Prices far below the area’s rate, a seller who “must sell today”, a seller who won’t let you do a search, or family land sold by one family member alone are all big warning signs. With family land, the family head and principal members must sign.

💸 Typical costs on top of the land price

Costs differ a lot by state and location, so ask before you start. Expect to pay for: the surveyor and charting, legal fees (often a percentage of the price), the agent (if any), stamp duty, registration and consent fees at the state Land Registry, and fencing or “foundation” fees demanded by some communities. Ask the lawyer for a full written estimate.

💡
Protect it after buying

Put a beacon on each corner and fence or build something small soon after buying. Empty land with no sign of the owner is the easiest to resell or grab.

✅
Online checks

Some states let you search land records or check coordinates online, e.g. Lagos’ e-GIS services. Ask your lawyer or the state Ministry of Lands what is available.

Frequently asked questions

Is a receipt enough to prove I own land?

No. A receipt only shows you paid someone. You need a properly executed and registered Deed of Assignment and, for land with a C of O, Governor’s Consent.

Can I buy land without a C of O?

Many plots are sold with only a survey and Deed of Assignment, especially family land. It is riskier; do the charting and search, and plan to process the title afterwards.

What is government acquisition?

Land the government has taken for public use (roads, schools, estates). Buying it is very risky because it can be taken back without compensation to you. A surveyor’s charting shows this.

Should I use an estate agent?

A good agent helps you find land, but they are not a substitute for your own surveyor and lawyer.
